The ESF Exploratory Workshop jointly organised by the Institute for International Legai Studies (ISGI) of the Italian National Research Council (CNR) and the Institute for Legai Studies of the Hungarian Academy of Sciences (HAS), in co-operation with the Institute of State and Law of the Czech Academy of Sciences, was held in Budapest from 20 to 22 September 2007 to assess how better to ensure the "good governance" of the mountain regions in Europe. It started with the case of two international treaties applicable to European mountain regions, namely the Carpathian and Alpine Conventions, which were taken as a model. The Workshop was based on the premise that it is possible to achieve the "full implementation" of the above mentioned international treaties and the "harmonisation" of mountain region management systems, including so-called transboundary co-operation. Building upon that, the Workshop dealt with current issues within international environmental law in the light of the two Conventions. The written contributions contained in this volume give an overview of the issues examined and discussed during the Workshop. They do not present an imaginary picture; on the contrary, they point out that if action is not rapidly taken within the framework of such Conventions, through cooperation between all the concerned actors, these naturai treasures will rapidly deteriorate and disappear. In this context, the special attention paid to the role of major groups, particularly the NGOs, in stimulating sustainable mountain development, as well as the human rights based approach, seem to be fully subscribed. Moreover, the case of these two international treaties, the Alpine and the Carpathian Conventions, clearly illustrates the destiny of the mountains region environment in Europe. Needless to say, the evident dichotomy between the socio-economic development, on one hand, and the sustainable use and protection of natural resources, on the other, plainly emerges from the analysis of the international legai instruments that are supposed to protect the Alps and the Carpathian mountains. Such " framework" instruments are per se almost meaningless if not followed by concrete action through their implementation; they are characterized by the inadequacy and weakness of the legal and institutional frameworks, which should be followed by cooperative action, including at the transboundary level. Otherwise, what is generated by these Conventions does not deserve even the name of soft law and would better be described as "non law". This conclusion, that might be considered excessively pessimistic, is drawn from the assessment of the more recent developments in the field of international environmental law, which are frankly highly deceptive ... (omissis) ... The main merit of the Workshop was indeed that of raising awareness and spreading information among a large number of specialists from different countries. In this regard, I would like to commend the Hungarian team, headed by the distinguished colleague Vanda Lamm and composed of Balàzs Majtényi and Henrietta Csàszàr, with whom Gianfranco Tamburelli, working on behalf of the ISGI of Rome, efficiently collaborated. Initiatives such as this are particularly helpful in strengthening, albeit indirectly, cooperation activities for the good governance of the mountains regions in Europe. The Workshop, in our opinion, achieved its original goal, and we are confident that it will promote the setting up of networks of researchers dealing with the legai and social aspects of sustainable development, so that further initiatives will be able to build upon it. - - - Preface by Sergio Marchisio / Institute for International Legai Studies (ISGI-CNR) of Rome, Director
