Human Rights of Asylum Seekers in Italy and Hungary. Infuence of International and EU Law on Domestic Action

Italy has been a long target of Mediterranean crossings, while Hungary is a relatively new target of mass migration. The comparative analysis of the sector legislation of these two countries, and of their relation with European and international law, will highlight fundamental trends and challenges concerning the future of handling migration towards the EU. The research will focus on the effectiveness of European and international regulations through the analysis of their implementation in Italy and Hungary. Two main sets of questions will be evaluated: the obligations of the states, in particular of the border states, and the implications on human rights. The aim of this research is to identify the limits and paths of state actions in Italy and Hungary, eventually defining proposals for further harmonizing and making effective, international, EU and national law in this sector.

Diritti umani dei richiedenti asilo in Italia e Ungheria - Impatto del diritto internazionale e del diritto comunitario sui ricorsi interni L'Italia è da lungo tempo meta di attraversamenti del Mediterraneo, mentre l'Ungheria è meta relativamente nuova di migrazione di massa. L'analisi comparata delle normative di settore di questi due paesi e del loro rapporto con il diritto europeo e internazionale metterà in evidenza le tendenze e le sfide riguardanti il futuro della gestione dei flussi migratori verso l'UE. La ricerca si concentrerà sull'efficacia delle normative europee e internazionali attraverso l'analisi della loro attuazione in Italia e in Ungheria. Due principali serie di questioni verranno valutate: gli obblighi degli stati, in particolare degli stati di confine, e le implicazioni sui diritti umani. Scopo della ricerca è quello di individuare limiti e percorsi delle azioni statali in Italia e in Ungheria, anche ai fini dell'eventuale definizione di proposte per l'ulteriore armonizzazione e effettività delle rilevanti regolamentazioni internazionali, comunitarie e nazionali.
