The 'API for Justice' is a EU co-funded project, coordinated by the Dutch Ministry of Justice which aims to open up the infrastructure for cross border legal services provided by e-CODEX and the European e-Justice portal, by means of an API (Application Programming Interface) to providers of added value services. This would make it possible for third parties to build applications which use the e-CODEX and e-Justice portal infrastructure and services. The rationale behind this project is that effective access to cross-border legal procedures is essential not only for the European internal market, but also for the protection of the rights of EU citizens living, working and making business more and more on an EU scale. At the same time, existing cross border judicial procedures seem to be ill equipped and ill suited to provide effective judicial solutions needed. As an example, the European Small Claim Procedure (ESCP), the EU generic procedure to deal with disputes around cross border commercial activities of limited economic value, like car rental, webshops or hotel bookings has been recognized as too demanding for citizens to use. Forms are too long and difficult to fill in, guidelines provided are often too generic compared to the specificities of national implementations of the procedure, etc. At the same time, the e-Justice Action Plan 2014 - 2018 has recognized that easier access to cross border procedures can be achieved through multiple channels. In line with this observation, this project aims to enhance the existing EU e-Justice infrastructure (e-CODEX platform and the e-Justice portal) with an interface for alternative entry points for cross border legal procedures. An alternative entry point could - for example - be an online dispute resolution centre to support consumers in dealing with a specific type of dispute. A key element to achieve this objective is to develop a method to investigate and describe potential use cases and user needs, and to clarify the legal constraints and requirements for the connection of the e-CODEX platform and e-Justice portal with applications from Member States, European Institutions or third parties. The next step is to develop the legal framework and technical specifications of such an interface.
