The development and widespread adoption of artificial intelligence, along with the rapid growth in the use of its models—including in the public and research sectors—has led to the need for the European Union to regulate the entire field through the adoption of the AI Act (EU Regulation 2024/1689); with this regulation, the EU sought to address a range of needs and risks associated with the use of AI, pioneering the creation of common rules for all member states, facilitating and standardising the use of AI whilst ensuring that such regulation is adaptable to the scope of application. The aim of this report is to analyse how such AI regulation might impact research and to attempt to provide guidelines to support a management plan that controls its criteria, operational applications, limits and limitations. AI management in research, in light of the recent AI Act, requires a phased management approach: defining the type of AI model within the relevant regulatory framework, determining the scope of applicability for the ‘deployer’ (provider/user), the level of risk associated with the AI model being applied, and, based on these premises, finally, what obligations must be met. So it’s clear that Regulation (EU) 2024/1689 is taking us towards a Europe-wide management approach aimed at regulating the use of AI in line with the guidelines it provides, so as to prevent inappropriate use and mitigate risks, thereby offering significant support to AI as a driver of research.
