The originality of this work consists in the critical analisys of the different international cases concerning the application of the precautionary principle. In particular, the analysis of State and International Judicial practice allows the author to find out a new trend in International law of the sea: Indeed, in the field of sustainable fisheries, the precautionary principle seems to be widely accepted by States as a customary rule. On the contrary, in different fields, such as marine pollution caused by industrial activities, we cannot conclude in this sense yet.
