The question that this contribution deals with is whether the Regions, urged by the need for renewal that emerged in the Nineties following the reforms, did or did not renew the contents of their laws and made room for quality. Can it be stated that, in general, compared to the first regionalization phase, the regional laws produced after the reform have characteristics that are substantially and qualitatively new? In order to answer this question, considering the available data, some more specific questions are discussed. The first concerns the quantitative and qualitative profile, namely whether after the reform the number of regional laws increased or decreased and what type of regional laws were produced. The second concerns the issue as to whether any regional residual legislative power was developed. This was a qualifying novelty of the reform that, we suppose, aimed at strengthening the substantial nature of regional laws. The third issue concerns the legislative environment and hence the boundaries within which the new regional legislation developed. On the basis of the analysis of the data, it can be stated that the effect of the administrative and constitutional reforms was to strengthen the regional sources and, in general, the figure of the region as a political and legislative body, albeit with reference only to a portion of the concrete areas of competence.
L'interrogativo che i contributo affronta è se le regioni abbiano operato - sulla spinta delle esigenze di rinnovamento manifestatesi negli anni Novanta e a seguito delle riforme - in modo tale da dare realmente una nuova sostanza alle loro leggi, contemporaneamente dando spazio ai profili della qualità. Così che si possa dire che le leggi regionali in genere presentino un carattere sostanzialmente e qualitativamente nuovo rispetto alle leggi della prima fase di regionalizzazione. Al fine di rispondere a tale interrogativo, sulla base dei dati disponibili, vengono affrontate alcune questioni più puntuali. La prima riguarda un profilo insieme quantitativo e qualitativo, vale a dire se dopo le riforme il numero delle leggi regionali sia andato aumentando o diminuendo e che tipo di leggi le regioni abbiano soprattutto prodotto. La seconda riguarda lo sviluppo o meno della potestà legislativa residuale regionale, una novità qualificante della riforma che va nel senso - si può supporre - del rafforzamento del carattere sostanziale delle leggi regionali. La terza questione riguarda l'ambito materiale e, quindi, i limiti nei quali la nuova produzione legislativa regionale si è sviluppata. Sulla base dell'analisi dei dati si può ritenere che dalle riforme amministrative e costituzionali sia scaturito un rafforzamento delle fonti regionali e, in generale, della figura della regione ente politico-legislativo, sia pure con riferimento ad una parte degli ambiti materiali di competenza.
