This article raises the configuration of the right of access to the Internet as a new law, which, although does not have an explicit regulatory approval, has a strong tone constitutional. The objective will be just what the legal status of the right of access to the Internet, which is proposed in its intrinsic structure and biphasic. From one side it is configured as a fundamental right and thus comprise all activities relating to the right to be informed and to inform. On the other hand, the Internet presents itself as social right instrumental to the exercise of other rights. This right can be claimed by members of a given community against their political authorities. But in national experiences such as the Italian, the formal equality, it seems inadequate to implement the principle of equality for the presence of subjective situations and unequal starting positions that benefit certain subsidiaries against others.
