The to paper aims to analyse in critical manner UE two-faced approach to the Biodiversity rights, proposing Mutually agreed terms and patents based on ?benefit sharing? to local community avoiding multinational model. Particular attention will be posed by increasing the benefits for the local communities that traditionally maintain biodiversity and traditional knowledge, under the light of Article 2, prot. 1 of ECHR and Regulation (EU) 511/2014 on the measure for users from the Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from the Utilisation in the European Union. Due to the fact, just in the second part of 2015 the articles 4, 7 and 9 of the Regulation, as mentioned above, will enter into force. The articles , respectively, run "Obligations of Users" (natural/legal persons that utilise genetic resources or traditional knowledge associated with genetic resources), the "Monitoring user compliance" and the checking of user compliance"
