Unity and Diversity in the Italy (Partially) Asymmetric Regionalism in Light of Contemporary Constitutional Reform

In the current phase, in which the Italian regionalism is involved in a new project of reform, it has also been reopened the debate about the special Regions, to which - due to the so-called safeguard clause - the new rules on the division of competence would not apply until the revision of their statutes on the basis of agreements with them. The transitional provision gives rise to multiple nodes of interpretation to be resolved, especially with regard to the procedural aspects of the revision of the Statutes. In any case it must be concluded that it is able to produce the effect of giving rise to a greater autonomy "of result" of special Regions autonomies, deriving from maintaining the status quo ante.

Nell'attuale fase, in cui il regionalismo italiano è interessato da un nuovo progetto di riforma, si è riaperta la discussione anche in merito alle autonomie differenziate, a cui - per effetto della c.d. clausola di salvaguardia - le nuove regole sul riparto di competenza non si applicherebbero fino alla revisione dei rispettivi statuti sulla base di intese con le medesime. La disposizione transitoria dà luogo a molteplici nodi interpretativi da sciogliere, soprattutto per quanto riguarda i profili procedurali della revisione degli Statuti. In ogni caso deve ritenersi che essa sia in grado di produrre l'effetto di dar luogo ad una maggior autonomia "di risulta" delle autonomie differenziate derivante dal mantenimento dello status quo ante.
