The aim of this paper was to analyse some of the most critical aspects in the case law of the Court of Justice of the European Union (CJEU) concerning the application of the Dublin Regulation in the light of the Charter of Fundamental Rights. Special attention has been given to the measures adopted by the Council (temporary relocation mechanism) and the Commission (proposed change to the Dublin III Regulation) to manage the crisis that started in the Mediterranean in 2015, checking whether they comply with the case law of the Court and with the Charter.

Abstract
