The modern legal system of protection of wine has deep roots in history. The present paper contributes to point out – under a comparative point of view – the evolution of the relevant regulation and the grounds thereof, starting from the analysis of some documents of XVIII century. The significant historical background explains the current privileged legal status of wine which is anyway subject to the interpretation of various judicial authorities having the effect to draw the direction of the future possible legal and economic development in the field.
