With the reform of Title V of the Italian Constitution, the terms "agriculture", "fishing" and "hunting" disappear from the text of the art. 117: they don't appear in the lists of State powers, either exclusively or concurrently. The most logical conclusion that the doctrine immediately reached was that these matters belonged to the "residual regional jurisdiction", as the Constitutional Court soon confirmed on the occasion of several rulings. This paper aims to reconstruct, also through constitutional jurisprudence, the content and boundaries of these matters, the points of contact and the possible interference with State competences of a concurrent and exclusive nature and, finally, analyzes the regional legislation produced in these matters from 2001 onwards in order to understand the extent of the substantial contents of the subjects themselves
Con la riforma del Titolo V della Costituzione i termini "agricoltura", "pesca" e "caccia" scompaiono dal testo dell'art. 117: essi, infatti, non figurano negli elenchi delle attribuzioni statali, né in via riservata né concorrente. La conclusione più logica cui giunse, fin da subito, la dottrina fu quella del conferimento di tali materie alla competenza residuale regionale, come, d'altronde confermò a breve anche la Corte costituzionale in occasione di numerose sentenze. Il presente contributo si propone di ricostruire, anche attraverso la giurisprudenza costituzionale, il contenuto e i confini di dette materie, i punti di contatto e le possibili interferenze con le competenze statali di natura concorrente ed esclusiva e analizza, infine, la normativa regionale prodotta nelle materie oggetto d'indagine dal 2001 in poi allo scopo di comprendere l'estensione dei contenuti sostanziali delle materie stesse.
