Vent'anni di competenza residuale regionale in materia d'agricoltura: uno sguardo di sintesi

With the reform of Title V of the Constitution, the "agriculture" matter passed from the shared competence between the State and the Regions to the residual regional one. This change, however, did not mean "exclusivity" of regional power, because it had to deal not only with state interventions capable of affecting agriculture, but, above all, with European Union law. The different aspects of agricultural activity addressed by regional legislation show, however, how the Regions have been able to maintain, over time, an important role in regulating the sector.

Con la riforma del Titolo V della Costituzione la materia "agricoltura" è passata dalla competenza concorrente tra Stato e Regioni a quella residuale regionale. Il mutamento del titolo competenziale, però, non ha significato "esclusività" del potere regionale, avendo dovuto quest'ultimo confrontarsi non solo con gli interventi statali capaci d'incidere la materia agricoltura, ma, soprattutto con il diritto dell'Unione europea. I diversi fronti su cui si indirizza la legislazione regionale in agricoltura mostrano, tuttavia, come le Regioni abbiano saputo mantenere, nel tempo, un ruolo importante nella regolazione del settore.
