Artificial Intelligence systems are widely used to infer the emotions of people, although this use has been criticized by scholars, associations, and institutions, especially when it is based on the analysis of the facial expression of the individual. In this paper we examine the issues of these technologies, how they are regulated by the new European Artificial Intelligence Act, and the risks they pose from an ethical and le gal point of view. From this study, we identify the need for an additional safeguard to protect the individual from decisions taken using facial emotion recognition systems, and we theorize a new "right to re fuse" the assessment of these technologies which should allow the per son to take back control over the expression of their own emotions.
