The implementation of Artificial Intelligence (AI) in medical de- vices and its application in the legal field are topics of great significance and contemporary interest. This article thoroughly examines the utilization of AI in these domains, analyzing the pertinent European regulations, notably the Artificial Intelligence Act proposal and the European Regulation on Medical Devices. Throughout the analysis, the inquiry arises concerning how biases present in the training data impact the outcomes and potentially encroach upon fundamental rights, such as the right to health and a fair trial, thereby potential- ly discriminating against individuals belonging to underrepresented groups in these datasets. Employing an interdisciplinary approach, this study endeavors to identify solutions to address this issue by leveraging the existing regulations, which could serve as a foundation for their adaptation in other sectors beyond the ones under consideration.

Descrizione: L'implementazione dell'Intelligenza Artificiale (IA) nei dispositivi medici e la sua applicazione nel campo giuridico sono temi di grande rilevanza e attualità. Questo articolo esamina in modo approfondito l'utilizzo dell'IA in questi ambiti, analizzando le pertinenti normative europee, in particolare la proposta di Artificial Intelligence Act e il Regolamento Europeo sui Dispositivi Medici. Nel corso dell'analisi, sorge la questione di come i bias presenti nei dataset di addestramento possano influenzare i risultati e potenzialmente ledere diritti fondamentali, come il diritto alla salute e quello a un processo equo, arrivando così a discriminare individui appartenenti a gruppi sottorappresentati in tali dataset. Adottando un approccio interdisciplinare, questo studio si propone di individuare soluzioni per affrontare questa problematica, sfruttando le normative esistenti che potrebbero costituire una base per la loro adattabilità ad altri settori oltre a quelli considerati.
